Terms of Service

These Terms of Service ("Terms") govern your use of the Prachi POS Android application ("Prachi POS", the "Service"), provided by Fragmasoft Solutions ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and operating a legitimate business in India to use Prachi POS. By using the Service, you confirm that the information you provide during onboarding is accurate.

2. Account and authentication

Accounts are created using your Indian mobile number, verified via SMS OTP through Firebase Authentication. You are responsible for keeping access to your phone number secure. Notify us immediately at info@fragmasoft.com if you believe your account has been used without your permission.

3. Free trial

New accounts receive a 30-day free trial with full access to the Service. No payment information is required to start the trial. At the end of the trial, continued use of the Service requires an active paid subscription.

4. Subscription and payments

• The subscription fee is ₹299 per month, inclusive of applicable taxes unless stated otherwise.
• Payments are processed by Razorpay. We do not store your card or UPI details.
• Subscriptions renew automatically each month unless cancelled before the next billing date.
• We may change the subscription fee with at least 30 days' notice in the app or by email. Continued use after the change constitutes acceptance of the new fee.

5. Cancellation and refunds

• You can cancel your subscription at any time from within the app or by emailing info@fragmasoft.com.
• Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date.
• Subscription fees are non-refundable except where required by Indian consumer protection law. Partial-month refunds are not provided.
• After cancellation, your data is retained for 90 days as described in our Privacy Policy, then permanently deleted.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to circumvent payment verification, security rules, or access another user's data.
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by applicable law.
• Resell, sublicense, or redistribute the Service without our written permission.

We may suspend or terminate accounts that violate these rules.

7. Your data

You retain ownership of the business data you enter into Prachi POS (menu, orders, expenses, shop profile). We process this data only to provide the Service, as described in our Privacy Policy. You can export or delete your data at any time.

8. Service availability

We aim to keep Prachi POS available at all times, but we do not guarantee uninterrupted service. The Service depends on third-party providers (Firebase, Razorpay) and your device's internet connectivity. Offline-first features are designed to keep you operational during network outages, but sync requires connectivity.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be error-free, secure, or meet your specific business requirements. You are responsible for maintaining your own backups and for compliance with applicable tax, GST, and business regulations.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the subscription fees you paid in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill.

11. Indemnity

You agree to indemnify and hold Fragmasoft Solutions harmless from any claims arising from your use of the Service in violation of these Terms or applicable law.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified within the app or by email. Continued use of the Service after the effective date of the updated Terms constitutes acceptance.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or related to the Service or these Terms shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.
